EU AI Act Compliance Deadline Approaches for High-Risk System Providers

What Happened

The European Commission has published updated technical guidance on how businesses must demonstrate compliance with the EU AI Act for systems classified as high-risk. The guidance clarifies what documentation, testing records, and human oversight processes will be expected during audits ahead of the August 2026 deadline.

High-risk categories include AI used in hiring, credit decisions, education, health, and critical infrastructure.

Why It Matters

If your business operates in the EU or serves EU customers, and you use AI to make or assist with decisions in any of these areas, you are likely in scope. The consequences of non-compliance include fines of up to 30 million euros or 6 percent of global annual turnover, whichever is higher.

Many founders who have built AI tools into their hiring workflows, loan assessments, or customer-facing recommendation systems may not have fully assessed their risk classification yet. Now is the time to do that.

The guidance also confirms that using a third-party AI model does not remove your compliance obligation. If your product makes high-risk decisions using AI, you remain responsible for demonstrating that the system is safe, transparent, and auditable.

What to Do

Start by mapping where AI touches your business decisions and whether any of those areas fall into the high-risk categories listed in the Act. The Commission has a public classification guide that can help.

If you are in scope, engage a legal adviser familiar with EU AI regulation as soon as possible. Building the required documentation from scratch takes longer than most businesses expect. Four months is not much time.
